RICHMOND, Va. -- A fight over data center taxes is threatening to derail Virginia's state budget, putting the commonwealth's reputation as a top business destination at risk. Lawmakers are deeply divided on whether to end a tax exemption for data centers earlier than planned, a move that could bring in hundreds of millions of dollars for schools and roads but might also scare off future tech investment.
The current exemption, set to expire in 2035, has helped Virginia become the data center capital of the world. But with the state facing a budget shortfall, some legislators want to sunset the break by 2029 to close the gap. Others argue that pulling the rug out from under the industry now would send a terrible signal to companies considering locating in Virginia. They say it would break promises made to firms that already built massive facilities based on the existing tax rules.
The impasse has already delayed the passage of the two-year spending plan past the July 1 deadline. Without a budget, state agencies are operating on continuing funding, and major projects are on hold. Business groups warn that the uncertainty is worse than any specific tax change. They point to neighboring states like North Carolina and Tennessee, which are aggressively courting data centers with their own incentives.
Governor Glenn Youngkin has called for a compromise but has not taken a firm public stance on the early repeal. He has stressed the need to keep Virginia competitive while also funding core services. As the standoff continues into the summer, the outcome will likely define how the state is viewed by corporate leaders for years to come.
